Account Creation

To use KAIJUBEAM, you must create an account by providing accurate and complete information. You agree to:

• Provide truthful, accurate, and complete information
• Maintain and update your information as needed
• Keep your account credentials secure and confidential
• Notify us immediately of any unauthorized account access

Account Responsibility

You are solely responsible for all activity on your account. We are not liable for any loss or damage from unauthorized account use.

One Account Policy

You may maintain only one KAIJUBEAM account. Creating multiple accounts or fake profiles is prohibited.

Permitted Use

You may use KAIJUBEAM only for lawful purposes and in accordance with these Terms. You agree to use the Service respectfully and professionally.

Prohibited Activities

You may not:

• Violate laws or regulations of any jurisdiction
• Harass, threaten, or intimidate other users
• Post hate speech, discriminatory content, or content that promotes violence
• Share illegal, harmful, or offensive content
• Create fake profiles or impersonate others
• Spam or send unsolicited commercial communications
• Scrape, crawl, or extract data from our platform
• Reverse engineer or attempt to access our source code
• Use automated tools or bots to access the Service
• Interfere with or disrupt the Service or its infrastructure
• Share content that infringes intellectual property rights
• Engage in fraudulent or deceptive practices
• Manipulate voting or competition results through collusion or fake accounts
• Post malware, viruses, or malicious code

Community Guidelines

In communities and hackathon competitions, you must:

• Respect other users and maintain professional discourse
• Provide honest and constructive feedback in votes
• Respect community-specific rules set by leaders
• Report violations through our reporting system

Your Content

You retain ownership of content you post on KAIJUBEAM (“Your Content”), including submissions, images, feedback, and profile information.

License to KAIJUBEAM

By posting Your Content, you grant KAIJUBEAM a worldwide, non-exclusive, royalty-free license to:

• Display, distribute, and reproduce Your Content on the platform
• Modify, adapt, and create derivative works for platform functionality
• Analyze Your Content for scoring, safety, and service enhancement
• Store and back up Your Content for service provision

This license continues until you delete Your Content or terminate your account.

KAIJUBEAM's Intellectual Property

KAIJUBEAM and its features, including our scoring system, design, software, and branding, are owned by Gilgami LLC and protected by intellectual property laws. You may not copy, modify, or create derivative works of our platform.

Respect for Others' IP

You may not post content that infringes others' intellectual property rights. We will respond to valid copyright infringement notices under the Digital Millennium Copyright Act (DMCA).

Community Self-Moderation

KAIJUBEAM uses a community-driven moderation system:

• You can report content that you believe violates our policies. We reserve the right, but not the obligation, to review and remove any content that violates these Terms.

Platform-Level Moderation

We reserve the right to review, remove, or restrict access to any content that violates these Terms, including submissions and community content.

No Obligation to Monitor

We have no obligation to monitor Your Content but may do so to ensure compliance with these Terms and applicable law.

Your Right to Delete Your Account

You have the right to terminate your account at any time. You can request account deletion through your account settings or by emailing us at zid@kaijubeam.com. When you delete your account, your personal data and content will be permanently removed from our active systems in accordance with our Privacy Policy.

Your Right to Access and Export Your Data

You have the right to request a copy of the personal data we hold about you. To request your data, please email us at zid@kaijubeam.com. We will provide your data in a common, machine-readable format (such as JSON).

Termination by KAIJUBEAM

We reserve the right to suspend or terminate your account at our sole discretion, with or without notice, if you violate these Terms, engage in illegal activity, or otherwise harm the platform or its users.

Effect of Termination

Upon termination of your account, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including, but not limited to, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Service Availability

KAIJUBEAM is provided “as-is” without guarantees of uptime, availability, or performance. We do not warrant that the Service will be uninterrupted or error-free.

Service Changes

We may modify, suspend, or discontinue any aspect of the Service at any time without notice, including:

• Adding or removing features
• Changing user interfaces
• Modifying scoring algorithms or competition rules
• Altering community structures or capabilities

No Compensation

You are not entitled to compensation for service changes, interruptions, or discontinuation.

Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• THE SERVICE IS PROVIDED “AS-IS” AND “AS-AVAILABLE”
• WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED
• WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY CONTENT
• WE DO NOT GUARANTEE ANY PARTICULAR COMPETITION OUTCOMES OR RESULTS

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM
• WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• WE SHALL NOT BE LIABLE FOR LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION
• SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU

User Content and Interactions

We are not responsible for:

• The accuracy or quality of user-generated content
• Interactions between users on or off the platform
• Any harm resulting from competition outcomes or user disputes
• Third-party content or services linked from our platform

Governing Law

These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law principles.

Dispute Resolution Process

For any dispute arising from these Terms or your use of KAIJUBEAM:

1. Informal Resolution: Contact us at zid@kaijubeam.com to attempt informal resolution
2. Binding Arbitration: If informal resolution fails, disputes will be resolved through binding arbitration under the rules of the American Arbitration Association
3. Court Jurisdiction: If arbitration is not applicable, disputes will be resolved in the state or federal courts of Wyoming

Class Action Waiver

YOU AGREE THAT DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS. YOU WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTIONS, COLLECTIVE ACTIONS, OR OTHER REPRESENTATIVE PROCEEDINGS.

Limitation Period

Any claim must be filed within one (1) year after the claim arises, or it will be permanently barred.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and KAIJUBEAM regarding the Service.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.

No Waiver

Our failure to enforce any provision does not constitute a waiver of that provision or any other provision.

Assignment

You may not assign your rights under these Terms. We may assign our rights and obligations without restriction.

Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control.

Survival

Provisions that by their nature should survive termination will survive, including payment obligations, disclaimers, limitation of liability, and dispute resolution.
